General Conditions of Sale

1 - PREAMBLE
The company MY PRETTY LOCKS (hereinafter “the Seller”) is a simplified joint stock company with capital of €1,000, registered in the Paris Trade and Companies Register under number 814 428 785. Its head office is located at 60 rue François 1er, 75008 Paris.
The purpose of these General Terms and Conditions of Sale (hereinafter "the GTC") is to determine the conditions under which the Seller sells its products and services on its website to a clientele composed of individuals or professionals (hereinafter "the Buyer" or "Buyers"). Before any transaction, the Buyer declares that he has full legal capacity to commit to these GTC.
The T&Cs apply to all products ordered on the website https://myprettylocks.com (hereinafter “the Site”).
2 - ACCEPTANCE OF THE GTC
These General Terms and Conditions are permanently accessible via the Site, in formats allowing them to be printed and/or downloaded (PDF), so that the Buyer can reproduce or save them.
They are also sent to the Buyer by email in PDF format with the order confirmation.
The General Terms and Conditions may be modified at any time and without notice by the Seller; these modifications will only apply to orders placed after their effective date.
The T&Cs are subject to French law.
3 – PRODUCTS
3-1 Availability
The products offered are those presented on the Site within the limits of available stocks. Each product is presented on the site in the form of a description including the main characteristics.
The Seller reserves the right to change the product assortment at any time.
In the event of unavailability of a product, the Seller will inform the Buyer of the restocking times and, if necessary, will offer an equivalent product or will cancel the order and reimburse the Buyer.
3-2 Responsibility
The Seller is not the manufacturer of the products, unless otherwise indicated. In the event of use of the products, the Seller cannot be held responsible for any damage suffered by the Buyer.
4 - PRICE
4.1 - Price of Products
For Customers in France, prices are displayed in euros (€) including VAT. Products are billed according to the rates in effect at the time of the order.
4.2 - Shipping Costs
Shipping costs vary depending on the delivery method chosen and are indicated before the order is confirmed.
5 - PAYMENT
All orders are paid in euros (€). Payment is made online via the methods offered on the Site, with payment providers such as Paypal and Shopify Payment. Transaction security is ensured by the SSL protocol.
The Seller reserves the right to suspend or cancel any order in the event of non-payment.
6 – DELIVERY
The Buyer chooses the delivery method and the carrier when confirming the order.
Products are shipped within one to two business days after ordering. Shipping costs are the responsibility of the Buyer.
7 – CUSTOMER ACCOUNT
The Buyer can create a Customer Account to facilitate their purchases and access loyalty programs.
8 – CUSTOMER REVIEWS
After making a purchase, an email will be sent to the Buyer to leave a review on the products
9 – REFERENCING OF PRODUCTS ON THE SITE
When searching by filter or keyword, products are classified by default according to the best sales recorded on the Site.
The Buyer has the possibility to modify this classification by using the filters available on the Site. He can choose from the following options:

Price: low to high

Price: high to low

Date: oldest to newest

Date: from newest to oldest
The Site's advertising banners may present products in partnership with the Seller, such as products benefiting from free samples offered by Suppliers.
10 - RIGHT OF WITHDRAWAL
In accordance with Articles L.221-18 et seq. of the Consumer Code, the Buyer has 14 days from receipt of his order to notify the Seller of his decision to withdraw.
To do this, the Buyer must:

Return the complete package at your own expense to the address [return address] within a maximum of 14 days following the sending of your withdrawal letter.

Check that all Products are complete, in good condition and in their original unopened packaging. In accordance with Article L221-28 5° of the Consumer Code, the Buyer will lose his right of withdrawal if the Products have been unsealed for reasons of hygiene or health protection.
If these conditions are met, the Seller will refund the amount of the order within 14 working days. The refund may be deferred until the returned product is recovered.
The Seller does not reimburse the cost of returning the product. The refund will be made using the same means of payment used by the Buyer when ordering.
11 – CONFORMITY AND HIDDEN DEFECTS
The seller is liable for defects in conformity of the goods to the contract in accordance with Articles L.211-4 et seq. of the Consumer Code and for hidden defects in the thing sold under the conditions provided for in Articles 1641 et seq. of the Civil Code.
When acting under the legal guarantee of conformity, the consumer:

benefits from a period of two years from delivery of the goods to take action;

may choose between repair or replacement of the property;

is exempt from providing proof of the existence of the lack of conformity during the twenty-four months following delivery of the goods.
The legal guarantee of conformity applies independently of any commercial guarantee that may have been granted.
For any warranty action, the Buyer must contact the Seller via the contact form [insert form URL] or by registered mail. The non-compliant or defective product must be returned in its original packaging.
In the event of a complaint relating to non-conformity, the Seller reserves the right to check the weight of the package recorded by its logistician.
12 - PERSONAL DATA
The Seller ensures the protection of the personal data of its Buyers, in accordance with the applicable regulations. For more information on the processing of your data, you can consult the privacy policy on the Site.
The Customer has the right to request access, rectification or erasure of his/her personal data, a limitation of their processing, as well as to oppose their processing and request their portability. These requests can be sent to contact@myprettylocks.com.
13 - INTELLECTUAL PROPERTY
The elements present on the site, including texts, photos, images, videos and data, are protected by intellectual property rights belonging to My Pretty Locks.
Any reproduction, adaptation or distribution of the elements is strictly prohibited, under penalty of prosecution for counterfeiting.
14 - MISCELLANEOUS
If one or more provisions of the General Terms and Conditions are deemed invalid, the other provisions shall retain their force and scope. The fact that the Seller does not assert any provision of these General Terms and Conditions at any given time shall not be interpreted as a definitive waiver.
15 – FORCE MAJEURE
A force majeure event is defined as an event beyond the control of the Seller, which could not reasonably have been foreseen at the time of entering into the contract and the effects of which cannot be avoided by appropriate measures, thus preventing the Seller from performing its obligations.
Force majeure events include, but are not limited to, events such as natural disasters, strikes, armed conflicts, government restrictions or administrative measures (such as lockdowns or curfews) related to epidemics such as COVID-19, significantly disrupting the manufacture, receipt or delivery of products.
In such cases, the obligations of the Parties are suspended, without the liability of either Party being incurred. If the force majeure event were to last more than three months, each Party may terminate the contract without notice by registered letter without this termination being considered as wrongful.
16 – CONSUMER MEDIATION
In accordance with Articles L.611-1 and R.612-1 et seq. of the Consumer Code concerning the amicable settlement of disputes, if the Buyer has sent a written complaint to My Pretty Locks and has not obtained satisfaction or a response within two months, he may submit his complaint free of charge to a consumer mediator.
The mediator must be contacted within a maximum of one year from the initial complaint. Information on the competent consumer mediator can be provided upon request to My Pretty Locks customer service.
